Third-Country Data Transfer

Other Data Transfers

We have concluded a data processing agreement with such external service providers in accordance with Article 28 of the General Data Protection Regulation. In this agreement, we oblige external service providers to maintain the confidentiality of your personal data and to take appropriate data security measures.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

In the event of misuse of our website, we reserve the right to forward provided personal data to the competent authorities.

Your Application

If you apply to us, we will process the personal data you provide and the documents you submit exclusively for the purpose of reviewing your application and carrying out the application process. In doing so, we rely on the fulfillment of pre-contractual obligations (Article 6 paragraph 1 litera b General Data Protection Regulation). Without processing your personal data, we would not be able to review your application and carry out the application process.

Without your prior explicit consent, your application will neither be kept on file nor forwarded to third (external) parties.

Your Donations

If you make a donation, we will use the personal data you provide exclusively for the purpose of processing and handling your order. In data processing, we rely on our legitimate interests (Article 6 paragraph 1 litera f General Data Protection Regulation). This also applies if you wish to receive advice from us on donation options. Without processing your personal data, we would not be able to process and handle your order.

A transfer of the personal data you provide will only take place if we engage external service providers for the processing of donation orders. We have concluded a data processing agreement with such external service providers in accordance with Article 28 of the General Data Protection Regulation. In this agreement, we oblige external service providers to maintain the confidentiality of your personal data and to take appropriate data security measures. Furthermore, the transfer of personal data to competent authorities is legally mandatory if you wish to consider the donation as a special expense (§ 18 paragraph 1 number 7 Income Tax Act). Finally, disclosure of personal data to auditing bodies (e.g., auditors, chartered accountants) may be necessary in accordance with legal provisions.

We may receive your personal data from third parties if, for example, you make a bank transfer and we receive corresponding information via our bank (e.g., IBAN, amount of donation, name, purpose of use).

Our Data Storage

Personal data provided by you will only be stored by us for as long as is necessary for the purposes mentioned above – for which we process the data. Specifically, the following retention periods are provided:

  • Server log files are deleted thirty days after the end of your website visit.
  • Data processed based on voluntary consent will be deleted after the duration specified in the consent or after your withdrawal.
  • Data required for the billing of our services will be deleted after 7 years from the end of the year in which they arose, in accordance with § 132 of the Federal Tax Code (e.g., donations).
  • Application data will be deleted 8 months after the end of the application process or after a rejection has been issued.

Due to legal documentation and retention obligations, a longer storage period may result. After the expiry of corresponding periods, your personal data will be deleted, provided that no other legal basis for longer-term storage exists under the General Data Protection Regulation.

Your Rights

You have the right to information,

  • whether we process your personal data,
  • for what purposes your personal data is processed,
  • which categories of your personal data are processed,
  • to which recipients your personal data is transmitted, and
  • how long your personal data is stored with us (Article 15 General Data Protection Regulation).

You have the right to rectification if your personal data is processed incorrectly. This also includes completion if your personal data is processed incompletely (Article 16 General Data Protection Regulation).

Under certain conditions, you have the right to erasure (“right to be forgotten”) if there is no longer a valid legal basis for processing your personal data under the General Data Protection Regulation (Article 17 General Data Protection Regulation).

Under certain conditions, you have the right to request the restriction of processing of your personal data (Article 18 General Data Protection Regulation).

You have the right to receive personal data that you have provided to us in a structured, commonly used, and machine-readable format and to transmit it to a third party of your choice (data portability), provided that the specific conditions for this are met (Article 20 General Data Protection Regulation).

If we base the processing of your personal data on our legitimate interests, you have the right to object on grounds relating to your particular situation (Article 21 General Data Protection Regulation).

If you have consented to the processing of your personal data, you have the right to withdraw your consent at any time (Article 7 paragraph 3 General Data Protection Regulation).

Whistleblower Protection. We Take Responsibility

Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law (hereinafter referred to as: “Directive”) and the Federal Act on the Procedure and Protection for Reports of Legal Violations in Certain Areas of Law (Whistleblower Protection Act – hereinafter referred to as: “HSchG”) are intended to ensure that breaches of EU legal provisions can be reported easily, securely, and confidentially.

In implementation of the Directive and the HSchG, the Verein Wiener Frauenhäuser has established an internal reporting office. Persons who have a professional relationship with us can contact this internal office and report breaches of Union law. At the request of the whistleblower, we also enable a telephone discussion or a personal meeting with our internal office. A request to this effect should be sent to the email address stated above.

Information pursuant to Article 13 of the General Data Protection Regulation

When a report concerning breaches of Union law is received, personal data provided is processed by our internal office insofar as this is necessary to fulfill its legal duties (Section 8 (1) HSchG).

Documentation of the internal office is stored for a period of five years after the conclusion of the procedure and beyond, insofar as it is necessary for the conduct of administrative or judicial proceedings already initiated (Section 8 (11) HSchG).
